The German procedure at Klaochow is, I understand,
precisely the same Az ours at "ei Fai Fei and it is prob-
able that the Viceroy at Canton, who was until recently
Governor of Shantung, is relying upon his knowledre of the
practice at both places in claiming jurisdiction in the
present instance.
In the lease of Port Arthur and Dalny, which was pre-
sumably the prototype of all these arrangements, it was
stipulated that in criminal cases the offenders were to
he handed over to the nearest Thinese officials, and a for-
tiori criminals who escaped tH to Chinese territory and
were arrested there would be amenable to Chinese furig-
diction.
I had hoped, hefore submitting the question to you
for a legal opinion, to have received the communication
which Mr.Jamieson expected the Governor of Hongkong would
address to me, as I thought it would furnish pranedents
bearing upon the question.
